1. Who We Are
This website, tippytappy.co (the "Site"), is operated by Tippy Tappy Pte. Ltd. (UEN: 202446585D), a company incorporated in Singapore, trading as "Tippy Tappy" or "Tippy Tappy Co." In these Terms of Service ("Terms"), "we", "us" and "our" refer to Tippy Tappy Pte. Ltd. Our registered office is at 60 Paya Lebar Road, #06-28 Paya Lebar Square, Singapore 409051.
2. Acceptance of These Terms
By accessing or using the Site, browsing our products, or placing an order, you agree to be bound by these Terms, together with our Privacy Policy, Shipping Policy and Refund Policy, which are incorporated into these Terms by reference. If you do not agree to these Terms, please do not use the Site.
We may update these Terms from time to time to reflect changes in our business or in applicable law. The version posted on this page at the time of your order is the version that applies to that order. Continued use of the Site after changes are posted means you accept the revised Terms.
3. Eligibility
You must be at least 18 years old, or the age of majority in your place of residence, to place an order on the Site. If you are under that age, you may only use the Site with the involvement of a parent or legal guardian.
4. Products, Pricing and Availability
We make every effort to describe and display our products accurately, including colours, materials and sizing, but we cannot guarantee that your device's display will show colours with complete accuracy.
All prices are listed in Singapore Dollars (SGD) unless otherwise stated at checkout, and are subject to change without notice. Prices displayed at the time you place an order are the prices that apply to that order.
Products are subject to availability. We reserve the right to limit quantities, discontinue a product, or refuse an order (for example, where a listing contains a pricing or description error), at our reasonable discretion and without liability to you, other than to refund any amount already paid for that order.
5. Orders and Payment
When you place an order, you are making an offer to purchase, which we may accept or decline. A contract of sale is only formed once we send you an order confirmation email.
You agree to provide accurate, current and complete information when placing an order, including your billing and shipping details, and to keep your account information (where applicable) up to date. Payments are processed securely through Shopify's payment infrastructure; we do not store your full payment card details.
6. Shipping and Delivery
Shipping destinations, rates, timelines, and responsibility for international duties and taxes are set out in our Shipping Policy, which forms part of these Terms. Delivery timeframes are estimates and not guaranteed, as they can be affected by factors outside our control, including customs clearance and carrier delays.
7. Returns and Refunds
Our approach to returns, exchanges and refunds, including timeframes and eligibility conditions, is set out in our Refund Policy, which forms part of these Terms. Nothing in our Refund Policy limits any right or remedy you have under Singapore law that cannot lawfully be excluded (see Section 8 below).
8. Your Rights Under Singapore Law
Nothing in these Terms is intended to exclude, restrict or modify any right or remedy that you have under Singapore law which cannot lawfully be excluded or limited, including any implied guarantee or condition as to the quality, merchantability, fitness for purpose, or accurate description of goods under the Sale of Goods Act 1979, the Consumer Protection (Fair Trading) Act 2003, or the Consumer Protection (Trade Descriptions and Safety Requirements) Act 1975.
Where such laws imply a warranty, guarantee or condition that cannot be excluded, but permit us to limit our liability for breach of that warranty, our liability is limited (at our option, and where permitted) to replacing the goods, supplying equivalent goods, repairing the goods, or refunding the price paid.
9. Intellectual Property
All content on the Site, including our logo, product photography, brand names, and written content, is owned by or licensed to Tippy Tappy Pte. Ltd. and is protected by intellectual property laws. You may not reproduce, distribute, or use our content for commercial purposes without our prior written permission.
10. Acceptable Use
When using the Site, you agree not to:
- use the Site for any unlawful purpose or in violation of any applicable law;
- submit false, misleading, or fraudulent information, including when placing an order;
- attempt to interfere with, disrupt, or gain unauthorised access to the Site or its underlying systems;
- transmit viruses, malware, or other harmful code; or
- harass, abuse, or harm another person through your use of the Site, including through reviews or submitted content.
We may suspend or terminate your access to the Site if we reasonably believe you have breached these Terms.
11. User Submissions
If you submit reviews, comments, or other content to us (for example, product reviews), you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that content in connection with operating and promoting the Site. You are responsible for ensuring your submissions do not infringe any third party's rights and are not unlawful, defamatory, or obscene.
12. Third-Party Tools and Links
The Site may link to, or make use of, third-party websites, platforms, or tools (for example, Shopify's platform infrastructure or payment processors) that we do not control. We are not responsible for the content, accuracy, or practices of third parties, and your use of any third-party service is subject to that party's own terms.
13. Limitation of Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under Singapore law.
Subject to the paragraph above and to Section 8, and to the fullest extent permitted by law, we will not be liable to you for any indirect or consequential loss (including loss of profits, business, or data) arising out of or in connection with your use of the Site or your purchase of products from us. Our total liability to you for any claim arising out of or in connection with an order will not exceed the amount you paid for the relevant order.
We do not exclude or limit liability where doing so would be unlawful, unreasonable, or contrary to the Unfair Contract Terms Act 1977 as applied in Singapore.
14. Indemnification
You agree to indemnify and hold Tippy Tappy Pte. Ltd., its officers, directors, and employees harmless from any claim or demand, including reasonable legal costs, arising out of your breach of these Terms or your violation of any law or the rights of a third party, except to the extent such claim arises from our own negligence or breach of these Terms.
15. Privacy
Our collection and use of your personal data is governed by our Privacy Policy, which explains how we handle your information in accordance with Singapore's Personal Data Protection Act 2012.
16. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be severed, and the remaining provisions will continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, Shipping Policy and Refund Policy, constitute the entire agreement between you and us regarding your use of the Site and supersede any prior agreements or understandings, whether written or oral.
18. Governing Law and Disputes
These Terms are governed by the laws of Singapore. Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts of Singapore.
